Overview
Closing Attorneys are integral to the real estate industry, providing the legal expertise necessary to finalize property transactions, safeguard clients' interests, and ensure compliance with relevant laws and regulations throughout the closing process. They facilitate the transfer of property ownership and uphold the integrity of real estate transactions, ensuring that funds are properly disbursed and that applicable regulatory requirements are met. Effective communication and collaboration with clients and stakeholders are key aspects of this role. Ideally, we are looking for someone who has experience both at the closing table and in processing (e.g., scheduling, reviewing title, ordering title binders, preparing and balancing CDs, drafting closing documents, etc.).
Key Responsibilities & Objectives
- Table signings for Residential and New Construction transactions, adhering to company, client, and jurisdictional processes; ensure seamless execution to meet legal and procedural requirements.
- Draft and review contracts, deeds, leases, and other legal documents; ensure accuracy and compliance with transaction terms.
- Review the closing statement to confirm the precision of all financial details and ensure alignment with transaction terms and regulations.
- Scrutinize loan documents and complete the closing package for accuracy and compliance with applicable laws; safeguard clients' legal and financial interests.
- Provide comprehensive legal advice to clients regarding transaction implications and address legal concerns arising during the transaction.
- Apply knowledge of title insurance policies to shield clients from potential title defects and inform clients about title-related risks and protections.
- Evaluate property surveys, inspections, and other relevant documentation to inform legal decisions.
- Conduct title examination to identify liens, encumbrances, or defects and ensure a clear and marketable title for clients.
- Develop and implement business development strategies to attract new clients and expand the client base; cultivate relationships with key stakeholders in the real estate industry.
- Participate in maintaining a tidy and organized office environment and assist with general administrative tasks as needed to support team operations.
Qualifications / Core Competencies
Active member of relevant state bar in good standing; state-specific Notary Public.In-depth understanding of real estate laws, regulations, and local ordinances; knowledge of property rights, land use, zoning laws, and environmental regulations.Knowledge of title insurance policies to protect clients against potential title defects; ability to evaluate property surveys, inspections, and other relevant documentation.Effective communication skills to explain complex legal concepts to clients and keep them informed throughout the process.Adherence to ethical standards and client confidentiality; compliance with all applicable laws and regulations.Strong problem solving and critical thinking skills; ability to analyze complex situations and develop creative legal solutions; proficiency in handling various real estate transactions (buying, selling, leasing, financing); drafting and reviewing contracts, deeds, leases, and other documents.Thorough title review to identify liens, encumbrances, or defects.Detail-oriented, able to work on a team, capable of prioritizing and multi-tasking.Success Factors
