The Oregon Public Defense Commission (OPDC) is an agency governed by a 13-member commission appointed by the Governor, which serves as the governing body for Oregon's public defense system. The Commission provides policy direction and oversight for the administration of the system. The legal services provided by OPDC represent an essential component of Oregon's public safety system. OPDC's mission is to ensure constitutionally competent and effective legal representation for persons eligible for a public defender. Its office includes the Executive, Appellate, Trial, Trial Development & Resources, and Administrative Services Divisions.

OPDC negotiates contracts with trial level public defense providers and administers and distributes funds for representation and related services for cases during the biennium for criminal, juvenile, and civil commitment cases. The Agency provides compliance and oversight to the trial community providers through quality assurance practices, training, and education. The Appellate Division provides direct legal representation in the state appellate courts in criminal cases, juvenile dependency and termination of parental rights cases, and parole cases. Other services in the Agency include, Data Collection and Analysis, General Counsel, Human Resources, Information Technology Services, Internal Audit, and Policy Development.

The primary purpose of this position is to develop, negotiate, and administer medium-level complex or risk contracts, agreements, and grants that may be politically sensitive and have multiple funding sources, funding arrangements and policy interpretation.

Duties

• Use a variety of methods such as Request for Proposals, Requests for Information, Invitation to Bid, to procure goods and services. Advise business partners about the most efficient and effective solicitation method to meet their needs. Comply with statutes, administrative rules, policies, and procedures related to each type of solicitation, the related selection process, and contract award process, including requirements for legal approval for release and legal sufficiency approval, when required. Maintain procurement file components.
• Advise managers and staff on procedures for developing contracts, agreements, and grants. Identify areas to improve standard operating procedures, assist with editing or writing original procedure documents, elicit input from other procurement analysts and obtain management approval to implement procedures.
• Collaborate with technical resource staff to develop specifications, requirements, and guidelines. Work with business partners to clearly identify scope of work and deliverables for solicitation and contract documents.
• Translate program requirements into contract terms. Follow standard operating procedures to develop final, legally compliant contract documents for execution.
• Evaluate proposed contract terms and conditions for potential performance risk. Collaborate with business partners to identify risk and develop mitigation strategies.
• Develop terms and conditions. Use standard templates to develop final contract documents. Obtain legal sufficiency approval from the Department of Justice.
• Develop solicitation strategies and evaluation methodologies. Administer and manage the procurement process.
• Lead pre-proposal conferences; clarify requirements. Prepare agenda for pre-proposal conferences in consultation with Project Manager or Program staff; facilitate conference, present procurement topics related to responding to the solicitation.
• Evaluate proposals received against selection criteria. Reject non-responsive proposals. Administer and manage proposal selection process.
• Respond to questions, requests for clarification, and solicitation-related protests in consultation with Procurement lead, Chief Procurement Officer, and General Counsel and / or Department of Justice as required.
• Negotiate contract terms to minimize performance risk.
• Collaborate with other state agencies and public agencies to develop cooperative procurement contracts and agreements. Prepare agreements for federal, state projects. Interpret funding guidelines, regulations, and policies an apply them to the development of the agreement. Recommend changes to project scope of work and budget based on agreement and funding requirements.
• Recommend agreement provisions to mitigate risk.

The posted salary range is the total possible range for the classification. If you are already a participating PERS member or once you become PERS eligible, the salary range will increase by 6%.
