Description

The Massachusetts Gaming Commission seeks applicants for the position of Associate General Counsel. This position serves the Commission as a member of the agency's legal department under the supervision of the General Counsel.

As part of the legal team, the Associate General Counsel will be called upon to offer legal advice and strategy on a wide variety of matters throughout the agency pertaining to the regulatory oversight of casino gaming, sports wagering, horse racing, and other matters under the Commission's purview.

Unique issues may arise daily that require careful research, thoughtful analysis, and response, to which the person serving in this capacity will be expected to diligently attend.

Ultimately, the Associate General Counsel assists in helping to ensure that the legal team provides sound, timely, and ethical legal advice to all Commissioners and agency staff.

Duties and responsibilities include, but are not limited to, the following :

  • Drafts, amends, and interprets agency regulations, rules, and policies;
  • Interprets and assists with compliance with respect to statutes and regulations related to agency affairs including, for example, the open meeting law and the public records law;

Advises the Commission and agency staff on matters related to G.L. c. 23K (gaming), G.L. c. 23N (sports wagering), G.L. c.

  • 128A (racing), G.L. c. 128C (simulcasting), 205 CMR, emerging areas of law under the Commission's regulatory authority, and the Commission's Enhanced Code of Ethics;
  • Communicates effectively with Commissioners and agency staff and engages in outward-facing communications with other government agencies, licensees, vendors, and members of the public;
  • Drafts, negotiates, and reviews contracts, MOUs, grants, and similar agreements;
  • Performs oversight and coordination of litigation against the agency;
  • Represents the Commission in hearings and appeals before the Commission's hearing officers or the full Commission;

Performs any associated administrative work.

Qualifications

  • Demonstrated capacity for sound legal analysis, legal reasoning, problem solving, and legal research and writing skills;
  • Experience with administrative law, government / legislative affairs, and / or litigation;
  • An even temperament, principled judgment, and a positive outlook;
  • Strong oral and written communication skills;

Experience with Relativity eDiscovery platform a plus.

Education and Experience :

A Juris Doctor Degree from an accredited law school and a current license to practice law in Massachusetts;

At least 4 years of experience working in a law firm, corporate in-house legal department, governmental agency, or similar setting.

MGC offers a hybrid work environment and requires staff to work for at least two days in the Boston Office. Based on business needs, additional in-office days may be required.

The successful candidate must pass an extensive background check, including a full credit check, CORI, drug screen, fingerprinting, and standing with the IRS and MA Department of Revenue.

The Massachusetts Gaming Commission is responsible for the implementation of the expanded gaming law (Chapter 194 of the Acts of 2011).

Under the law, the Commission is tasked with establishing a regulatory framework for the solicitation, licensing, taxation, and oversight of a maximum of three casino licenses and one slots parlor license in Massachusetts.
