Export Control / Data Security Attorney (Attorney 4)

Overview

Export Control / Data Security Attorney (Attorney 4) role at Los Alamos National Laboratory. The candidate will provide legal advice on U.S. export control regulations (EAR, ITAR, AEA) and data security including handling of classified material, Controlled Unclassified Information, Unclassified Controlled Nuclear Information, and Personally Identifiable Information, with familiarity of the Federal Privacy Act of 1974, state privacy statutes, GDPR, and FOIA.

Responsibilities

• Provide expert legal counsel on EAR, ITAR, and AEA compliance related to export-controlled goods, technology, software, and services.
• Advise on classified data handling and ensure compliance with security regulations governing controlled information.
• Provide advice on the full spectrum of data security including protection of classified material, CUI, ICCNI, PII, the Federal Privacy Act of 1974, state privacy statutes, GDPR, FOIA, etc.
• Conduct export control classifications, jurisdiction determinations, and license applications for controlled items.
• Develop and advise on corporate export compliance policies, procedures, and training programs.
• Prepare and submit export licenses, TAAs, CJ requests, and VSDs to BIS, DDTC, and DOE as needed.
• Provide legal support for internal investigations, audits, and risk assessments related to export compliance violations or concerns.
• Monitor regulatory updates and provide strategic guidance on changes to export control and data security laws.
• Collaborate with cross-functional teams to address regulatory risks and requirements.
• Interface with U.S. government agencies on export control matters and compliance inquiries.
• Represent the company in legal proceedings, regulatory filings, and government audits related to export controls and data security.

What You Need

Education / Experience

Juris Doctorate from an ABA-accredited law school; active bar admission (State Bar of New Mexico or another state). If licensed outside NM, must join NM State Bar or obtain In-House Counsel Limited License within one year of hire. Must have at least 12 years of post-bar experience in the specialty area.

Significant DOE facility experience or experience representing similar corporate / government clients is preferred.

Work Location

Hybrid work location in Los Alamos, with partial onsite / offsite work and a two-hour ground commute. Locations are at management discretion and can change with notice.

Clearance & Eligibility

Q clearance required; background investigation conducted by the Federal Government. Eligibility for access to classified matter required. U.S. citizenship generally required for clearance; dual citizenship may have additional considerations. See DOE Order 472.2 for details. Eligibility : must be 18+ with U.S. citizenship, unless in very limited circumstances.
