Minimum Qualifications This title is part of the New York Hiring for Emergency Limited Placement Statewide Program (NY HELPS).
HELPS Program titles may be filled via a noncompetitive appointment. This means that you do not need to take an exam to qualify, but you do need to meet the minimum qualifications of the title.
If you are hired under the HELPS Program, you will be first be appointed as a temporary employee. In May 2024, if you are performing successfully in the position, your appointment will be changed from temporary to permanent non-competitive.
Once you are in permanent status, your official probationary period will begin and you may take any promotion exam for which you are qualified.
At a future date (within one year of permanent appointment), employees hired under NY HELPS are expected to have their permanent non-competitive
employment status converted to permanent competitive status. You will not have to take an exam to gain permanent competitive status.
Non-Competitive Minimum Qualifications : Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience in the trial of issues in courts of record or in the conduct or trial of adversary proceedings, quasi-judicial in nature, before a governmental department or agency
Candidates who do not meet the minimum qualifications for Hearing Officer / Hearing Officer 1 can be appointed to a lower-level title and be advanced to the Hearing Officer title after meeting the requirements for advancement.
There are three appointment levels that candidates can be appointed to :
Level 1- G 18 equated ($65,001) Candidates must be a Law School graduate and / or be eligible for NYS Bar Admission
Level 2- G -20 equated ($72,032) Candidates must have Admission to the New York State Bar
Level 3- G 22 equated ($79,928) Candidates must have 12 months of service at Level 2, or Admission to the NYS Bar and 12 months of subsequent satisfactory legal experience in the trial of issues in courts of record or in the conduct or trial of adversary proceedings, quasi-judicial in nature, before a governmental department or agency.
Permanent Transfer : Current DOH employee with one year or more of permanent or contingent-permanent, competitive service as a Hearing Officer / Hearing Officer 1 (SG-25) OR a NYS employee with one year or more of permanent or contingent-permanent, competitive service in a position eligible for transfer to a Hearing Officer / Hearing Officer 1 position under Section 52.
6 or 70.4 of the Civil Service Law.
Preferred Qualifications : The preferred candidate will have experience working as counsel for public health insurance programs and / or with a legal services organization specializing in health law, in addition to experience in administrative law hearings.
Duties Description The NYSOH Appeals Unit is a unit of Hearing Officers who have jurisdiction to hear appeals from NY State of Health (Marketplace) applicants and enrollees involving eligibility and enrollment in Marketplace programs.
As an appeals adjudicator for the NY State of Health (Marketplace), the incumbent (s) of this position will be responsible for conducting hearings arising from appeals of eligibility determinations for health insurance and financial assistance.
The incumbent will also be responsible for conducting legal research and drafting decisions and dismissals resulting from those hearings.
Incumbent (s) will also be responsible for other projects as assigned.
