GENERAL DESCRIPTION :

The purpose of this position is to prepare and prosecute criminal cases in any court in which the 10th Circuit Solicitor’s Office represents the State of South Carolina. Duties include legal research, interviewing witnesses, preparing for court hearings and trials, and conducting court hearings and trials. This position must be able to be available 24 / 7 to respond to law enforcement with legal questions or issues.

• Prepares criminal cases for trial, hearings, and pleas.
• Represents the State in criminal cases in Court; i.e., preliminary hearings, motion hearings, pleas, and trials.
• Does legal research through review of current statutes and case law.
• Coordinates with other agencies (DSS, DMH, DPPP, Probate Court, etc.) to assure appropriate dispositions and / or placement of offenders.
• Reviews case files and discovery.
• Contacts witnesses / victims.
• Drafts legal documents.
• Conducts plea negotiations and pleas in General Sessions Court.
• Conducts plea negotiations, pleas, and trials in Magistrate and Municipal Courts.
• Advises / consults law enforcement on cases.
• Meets with victims on criminal cases, consults with law enforcement regarding legal issues, attends training seminars, and helps conduct legal education seminars.
• Manages docket for General Sessions Cases, including trying cases in General Sessions Court.
• Manages docket in Juvenile Court, including handling plea negotiations, pleas, and trials in Juvenile Court.
• Performs other related duties as assigned.

Requirements :

KNOWLEDGE, SKILLS, AND ABILITIES :

Knowledge of South Carolina codes, laws, regulations and court rules, including adequate legal knowledge to advise law enforcement and make informed decisions on case analysis.

Ability to communicate effectively orally and in writing with law enforcement, other attorneys, and victims of crimes.

Adequate computer skills to utilize case management systems and perform legal research.

EDUCATION AND EXPERIENCE :

Juris Doctor degree from an accredited law school, and seven (7) years of significant prosecutorial experience or related work experience; or an equivalent combination of education, training, and experience that provides the required knowledge, skills, and abilities.

LICENSES, CERTIFICATIONS, OR REGISTRATIONS :

Required : Member of the SC Bar, in good standing. Rule 403 requirements completed. SLED Security and Privacy Certification.

Preferred : None.

PHYSICAL DEMANDS :

The work is sedentary work which requires exerting up to 10 pounds of force occasionally and / or negligible amount of force frequently or constantly to lift, carry, push, pull, or otherwise move objects, including the human body.

WORK ENVIRONMENT :

Work is performed in a relatively safe, and secure office environment.
