GENERAL DESCRIPTION

The OAG’s Antitrust Division is seeking to hire an experienced, self-driven attorney capable of thriving in a collaborative work environment and independently overseeing cases with complex legal and factual issues.

The Antitrust Division is charged with investigating and prosecuting violations of the Texas Free Enterprise and Antitrust Act and federal antitrust statutes.

The Division’s caseload consists of highly complex and high-profile investigations and litigation which may involve antitrust violations such as monopolization, conspiracies among competitors, or anticompetitive mergers.

Matters investigated or litigated can be local, regional, or national in scope and may be coordinated with other state attorneys general, the Federal Trade Commission, or the U.

S. Department of Justice. Licensed attorneys with a demonstrable interest and / or experience in antitrust enforcement or litigation are encouraged to apply.

ESSENTIAL POSITION FUNCTIONS

Assistant Attorney General III :

  • Conducts entry level to complex antitrust and related litigation in both state and federal courts
  • Initiates and conducts antitrust and related law investigations, including directing investigator and economist activity
  • Provides antitrust and related information to state and local governments
  • Performs all phases of civil litigation of antitrust cases including the drafting of petitions, motions, pleadings, orders, briefs, discovery, and memorandum
  • Performs or directs legal research and report findings and conclusions
  • Assists in or coordinates others in preparing cases for trial
  • Represents the Office of the Attorney General before state or federal district and appellate courts
  • Prepares or coordinates the preparation of legal briefs, pleadings, and other legal documents
  • Provides legal advice, counsel and assistance to client state agencies, local prosecutors or law enforcement entities
  • Communicates with representatives of state agencies and consumers
  • Analyzes entry level to moderately complex factual and legal issues and develops evidence for filing of antitrust cases
  • Performs related work as assigned
  • Maintains relevant knowledge necessary to perform essential job functions
  • Attends work regularly in compliance with agreed-upon work schedule
  • Ensures security and confidentiality of sensitive and / or protected information
  • Complies with all agency policies and procedures, including those pertaining to ethics and integrity

Assistant Attorney General IV : All the above functions for an AAG III PLUS :

  • Manages a high volume of litigation cases and investigations
  • Assists with training and mentoring less tenured staff

MINIMUM QUALIFICATIONS

Assistant Attorney General III :

  • Education : Graduation from an accredited law school with a Juris Doctor (JD) degree
  • Licensed to practice law by the State Bar of Texas
  • Member in good standing with the State Bar of Texas
  • Experience : Two years of full-time experience as a licensed attorney working in the following (or closely related) fields : antitrust, complex civil litigation, commercial litigation
  • Knowledge of antitrust law and legal principles and practices
  • Skill in handling multiple tasks, prioritizing, and meeting deadlines
  • Skill in effective oral and written communication
  • Skill in exercising sound judgment and effective decision making
  • Ability to receive and respond positively to constructive feedback
  • Ability to work cooperatively with others in a professional office environment
  • Ability to provide excellent customer service
  • Ability to work in person at assigned OAG work location, perform all assigned tasks at designated OAG work space within OAG work location, and perform in-person work with coworkers (e.

g., collaborating, training, mentoring) for the entirety of every work week (unless on approved leave)

  • Ability to arrange for personal transportation for business-related travel
  • Ability to work more than 40 hours as needed and in compliance with the FLSA
  • Ability to travel (including overnight travel) up to 5%

Assistant Attorney General IV : All of the above qualifications for an AAG IV plus :

Experience : One additional year of full-time experience as a licensed attorney working in the following (or closely related) fields : antitrust, complex civil litigation, commercial litigation

PREFERRED QUALIFICATIONS

  • Experience : Antitrust matters or other document-intensive complex civil litigation
  • Knowledge : Laws and legal principles and practices relevant to Texas and federal antitrust and trade regulations statutes
  • Abilities : provide expertise in specific and relevant areas of law to Executive Administration, division management, and division attorneys;

handles or directs high-profile and / or complex litigation affecting the Antitrust Division; and serves as a mentor to division attorneys
