INTRODUCTION

This position is located in the Department on Disability Services (DDS), Office of the Chief of Staff, Human Capital Administration (HCA).

The Human Capital Administration plans, develops, and administers human resources services and provides position classification, position management, staffing and recruitment, employee, and labor relations;

staff development and training, performance management, personnel records maintenance; employee assistance; and management advisory services.

The incumbent in this position will provide legal advice to executive leadership, management, and the Human Capital Administrator, on a wide variety of employment, labor, and human resources laws and regulations.

MAJOR DUTIES

  • Providing legal advice and guidance to executive leadership and management on employment and labor law guidance.
  • Drafting memoranda, including separation letters, policies, recommendations, adverse actions, employee grievances, and other documents.
  • Examines, analyzes, and conducts legal review of various human resources documents. Performs research and provides oral and written opinions as a result of review.
  • Serves as the agency’s representative for hearings and mediations before the Office of Human Rights ( OHR ), the D.C. Office of Employee Appeals ( OEA ), and the U.

S. Equal Employment Opportunity Commission, and Public Employee Relations Board and assisting with case responsibilities, including preparing evidence, assisting with witness preparation.

  • Provide guidance to management on labor and employment matters and providing all manner of legal guidance to the DDS Human Capital Administration, as needed.
  • Provides legal analysis on complex ADA, FMLA and PFL matters, including denial of leave programs and accommodations.
  • Co-chairs investigations and provides legal analysis for sexual harassment reports, EEO position statements, and other documents as needed.
  • Keeps abreast of changes to the District Personnel manual and other laws related to the functions of DDS human resources;

and recommends appropriate course of action.

Performs other related duties as assigned.

Qualifications

  • All Candidates must possess a Juris Doctorate (J.D.) or LL.B degree from a law school accredited by the American Bar Association at the time of appointment;
  • Must be either a member in good standing of the District of Columbia Bar or be admitted in another United States jurisdiction and have an application submitted and pending for admission to the District of Columbia Bar;

Prefers incumbent one (1) full year of post J.D. professional legal experience.

Education, Licensures, Certifications And Other Requirements

As indicated above, an applicant must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LLB or JD).

Work Experience / Knowledge

Extensive knowledge of several titles of law, agency policies, regulations, and procedures; Federal and State laws; precedent agency and judicial decisions.

Extensive knowledge of employment and labor law, employee conduct standards, investigations of misconduct, proposed disciplinary actions, and investigations of equal employment discrimination complaints.

Knowledge of regulations and policy issuances concerning personnel, employment, and labor relations matters.

Extensive understanding of legal aspects of personnel, employment, and labor laws with emphasis on ethics, post-employment conflicts of interest, third party administrative proceedings, equal employment opportunity law, and District and Federal sector labor management relations law.

Highly developed skills in interpreting and applying legal knowledge in various situations.

Comprehensive skills in analysis and resolution of difficult legal issues in an orderly, systematic, and effective manner.

Extensive skills in interpreting and applying applicable laws, regulations, and practices, including agency policies and relevant judicial decisions.

Ability to articulate concerns and positions on extremely sensitive issues both orally and in writing.

This position is not in a collective bargaining unit.

Work Schedule

This position requires 4 days a week in the office.
