Job Description :

Assistant General Counsel II - OGC Legal Enforcement

Performs highly complex, senior-level legal and managerial work. Responsible for managing a team of attorneys in the Office of General Counsel-Legal Enforcement Section (OGC).

Work involves overseeing, planning and delivering legal services, preparing legal documents, participating in hearings, interpreting laws and regulations, and rendering legal advice and counsel.

Works under limited supervision, with responsibility for initiative and independent judgment, as well as collaboration with other staff.

Responsible for Enforcement Section performance goals, objectives and metrics. Reports to Deputy General Counsel.

Essential Job Duties :

1. Plans and organizes legal activities of the Section.

2. Enforces agency regulatory provisions and prosecutes violations.

3. Supervise and manage work of assigned team of attorneys in the Section, and provide developmental opportunities and mentoring as appropriate.

4. Coordinates the preparation of legal opinions, briefs, contracts, proposals, and reports.

5. Advises on legal matters and on the interpretation and application of agency regulations and state and federal laws.

6. Reviews drafts of laws, rules, and regulations affecting Commission operations.

7. Represents staff, interrogates witnesses, and reviews decisions rendered in Commission Hearings.

8. Assists in formulating, coordinating, and establishing policies and procedures.

9. Reviews bill filed during the legislative session, and provide testimony as required.

10. Participates in administrative, regulatory, evidentiary, and enforcement hearings.

Qualifications :

Minimum Qualifications :

1. Graduation from undergraduate school with a Bachelor's degree and from an accredited law school with a Juris Doctor (JD) degree.

Minimum 7 years' experience in practice of law in private practice and / or government, with experience handling litigation and administrative proceedings, or other relevant experience.

2. Licensed attorney in good standing with the State Bar of Texas.

3. Experience handling agency enforcement proceedings desired.

4. Experience implementing or using an automated docket management system desired.

Knowledge, Skills, and Abilities :

1. Strong working knowledge of the statutory and regulatory requirements for energy companies operating in Texas; found in the Texas Administrative Code and the Texas Natural Resources Code.

2. Knowledge of legal principles, practices, and proceedings; of state and federal laws, rules, and regulations; and of the Administrative Procedures Act and agency administrative rules and regulations.

3. Skill in : legal research, writing, and analysis; identifying and solving complex problems; interpreting and applying laws and regulations;

and using judgment to identify courses of action.

4. Ability to : manage a complex workload and the staff involved in performing the work; prioritize workloads and meet applicable goals, objectives and performance metrics;

and effectively recruit, retain, develop and mentor staff.

5. The ability to communicate clearly and concisely, both orally and in writing.

6. Ability to take initiative and work independently.

7. Ability to work effectively on a team.

8. Ability to address issues / concerns in a professional manner.

9. Ability to maintain working relationships with internal / external stakeholders.

10. Ability to respond to high pressure situations and meet changing demands and timelines.

11. Ability to understand and explain complex issues, including litigation, regulations and standards.

12. Proficient in the use of computer systems utilizing Microsoft Office Suite and database systems.

13. Demonstrate excellent organizational, communication and writing skills.

Work Hours and Telework : Standard office hours for Commission employees are 8 : 00 a.m. to 5 : 00 p.m., Monday through Friday.

Our agency offers alternate schedules for employees, as long as it does not adversely affect operations and service levels, and standard hours of operation are maintained.

The Commission may also offer telework based on the agency's approved Telework Plan. Alternate work schedules and telework may be discussed with the hiring manager during the interview process.
