Description
Under routine supervision is responsible for Small Claims Court related clerical duties.
Examples of Duties
The following duties are normal for this position. These are not to be construed as exclusive or all?inclusive. Other duties may be required and assigned.
- Interviews persons starting small claims court action and tells them about the Court’s policies and procedures.
- Assigns case number and return date. Types court calendar.
- Collects, verifies and records Small Claims filing fees, garnishments, liens, payments, satisfaction of judgments, and miscellaneous fees.
- Maintains lien docket as required. Vacates judgments, docketing and reopens cases.
- Enters judgment information on the court system to create a judgment document and forwards a copy to the parties.
- Closes cases upon completion.
- Explains garnishment procedures; furnishes appropriate forms.
- Provides clerical support for Intake Court on return dates by recording appearances and case status.
- Takes minutes for court proceedings (replevin & eviction trials). Receives, marks and record exhibits. Swears in witnesses.
- Prepare and enter writs, issue and cancel warrants for small claims.
- Examines weekly court files to be certain the Certificate of Service is enclose.
- Records mediation information, enters affidavits of non-compliance.
- Provides assistance to the civil / family / paternity clerk when needed.
Typical Qualifications
Desirable Knowledge and Abilities :
Must be a proficient typist. Must be able to effectively communicate with public by personal contact or telephone. Proficient in legal and business English, spelling and grammar.
Knowledge of court practices, procedures, and other legal references. Knowledge of modern office practices, procedures and efficient clerical processing methods.
Ability to exercise discretion with regard to confidentiality or judicial proceedings. Ability to receive cash and checks accurately.
Training and Experience :
High school graduate or the equivalent with 2 years of experience post high school in a law practice office or court related work.
In evaluating candidates for this position, the County may consider a combination of education, training and experience which provides the necessary knowledge, skills and abilities to perform the duties of the position.
