Job Description :
The Commercial Title Counsel will provide legal expertise and support in all aspects of commercial real estate transactions.
This role involves examining and underwriting commercial title insurance policies, resolving complex title issues, and offering legal guidance to clients and internal teams.
The ideal candidate will possess in-depth knowledge of commercial real estate law, strong analytical skills, and the ability to navigate complex legal and regulatory environments.
Key Responsibilities :
Title Examination and Underwriting :
Conduct thorough examination of commercial property titles to identify and resolve potential issues. Underwrite title insurance policies for commercial transactions, ensuring compliance with company and regulatory standards.
Review and analyze title commitments, surveys, plats, and other related documents.
Legal Support and Advisory :
Provide legal advice and support to clients, real estate professionals, and internal teams regarding title issues and commercial real estate transactions.
Interpret and explain legal documents and title-related matters to clients and colleagues. Assist in structuring and negotiating complex commercial real estate transactions.
Issue Resolution :
Identify and resolve title defects, boundary disputes, liens, encumbrances, and other title-related issues. Coordinate with underwriters, surveyors, and other parties to resolve discrepancies and ensure clear title.
Prepare and review curative documents, affidavits, and endorsements.
Documentation and Compliance :
Draft and review title insurance policies, endorsements, and other legal documents. Ensure compliance with all relevant laws, regulations, and company policies.
Maintain accurate and organized records of title examinations, communications, and resolutions.
Client Relations and Support :
Build and maintain strong relationships with clients, providing exceptional service and support throughout the transaction process.
Act as a point of contact for clients regarding title questions and concerns. Participate in client meetings, presentations, and training sessions as needed.
Continuing Education and Development :
Stay informed about changes in real estate law, title insurance regulations, and industry best practices. Participate in ongoing professional development and training opportunities.
Qualifications :
- Education : Juris Doctor (JD) degree from an accredited law school.
- Licensure : Active bar membership in the state where the company operates.
- Experience : Minimum of 5 years of experience in commercial real estate law, title insurance, or a related field.
- Knowledge : In-depth knowledge of commercial real estate transactions, title insurance underwriting, and relevant legal principles.
- Skills : Strong analytical and problem-solving abilities. Excellent written and verbal communication skills. Detail-oriented with the ability to manage multiple tasks and deadlines.
Proficient in legal research and use of related software tools. Ability to work collaboratively in a team-oriented environment.
