Old Republic Surety Company (ORSC) is currently seeking a Surety Claims Attorney to join its Claims Team at its home office located in Brookfield, WI.

Under the guidance of the President - Surety Claims, the Surety Claim Attorney handles contract and commercial surety claims processes and provides legal guidance and representation for claim-related matters.

This position is a resource to and has influence on a team of non-attorney claims representatives

DUTIES AND RESPONSIBILITIES :

Assure equitable claim service is performed in a timely manner involving performance, payment, and miscellaneous contract and commercial claims.

Provide underwriting with legal guidance on contract language and risk mitigation strategies.

Lead the investigation of multiple-project contract surety claims of higher complexity and evaluate project completion options.

Determine and implement chosen performance option, while coordinating with other project participants such as principals, obligees, attorneys, consultants, subcontractors, and suppliers.

Utilize information gathered through investigation to establish and maintain appropriate reserves, while simultaneously taking a proactive approach to mitigating loss.

Prepare internal reports for large-loss claims.

  • Identify the claim resolution and / or litigation strategies.
  • Negotiate and settle claims within authority limits by assessing coverage issues, developing any surety defenses, and effectively communicating liability determinations to all parties.

Attend, as the company's representative, arbitrations and mediations.

  • Draft and modify takeover agreements, completion agreements, subcontractor ratification agreements, and any other legal documents necessary to mitigate risk and discharge the company's bond obligations.
  • Pursue salvage, where necessary, pursuing indemnification / subrogation from all available sources.
  • Control allocated Loss Adjustment Expenses with effective use and collaboration with outside professionals such as attorneys, consultants, and accountants.
  • Other duties as assigned.

QUALIFICATIONS :

This position requires a Juris Doctorate Degree, with a current attorney's license, and a minimum of five years of related insurance claims experience, or an equivalent combination of education and experience.

Working as a Surety Claim Attorney requires one to work independently and effectively within a fast-paced environment. Proficiency with Microsoft (MS) Windows and Office products is necessary.

Other skills necessary include excellent oral and written communication skills, strong organizational and accurate proofreading skills, the ability to maintain accurate records, the ability to exercise discretion with confidential information, strong attention to detail, and the ability to use a variety of office equipment.

PHYSICAL AND ENVIRONMENTAL DEMANDS : This position requires one to sit for extended periods of time and stand and / or walk occasionally.

The position requires one to occasionally push, pull, carry, and / or lift up to 10 pounds. No personal protective equipment is required.
